Response to claim that Delta Institute associated doctors have lost their license to practice medicine:
Medical professionals and other eligible persons that are interested in sharing the BX Protocol™ with their patients or clients go through a general screening process. Interested parties must meet approval criteria in order to gain access to our proprietary resources. Every attempt is made to ensure the individuals promoting our protocol meet all eligibility criteria. If we become aware that doctors who are associated with us no longer meet these requirements, appropriate action is taken to rectify the situation.
Various doctors have become the target of slanderous activity because of their association with us. Doctors like Michael Lee Gerber areoften some of the most well-respected doctors in the integrative health field.
In recent months, nearly all professionals who are affiliated with us have experienced some sort of slanderous attack to varying degrees. Some high-profile affiliates have asked to sever their relationship with us. The majority have indicated it was not because they doubted the legitimacy of our company or program, but that it was simply due to the relentless attacks they’ve endured for being associated with us.Approximately 1600 fabrications, character assassinations, harassment, and a variety of defamation and personal attacks directed toward almost anyone mentioning the BX Protocol™ in a positive light, have been distributed. We do not feel the need to innumerate the details, but it is important to mention. The attacks have been directed mostly toward integrative practitioners in about 12 of the 18 countries that Delta has affiliates in. Their attacks are based on distortion and falsehoods and have had the general effect of increasing support for those being attacked.
It is important to complete further research rather than take these attacks at face value. It is also vital to know that sources such as Quack-watch, are well-known paid disinformation services for pharmaceutical companies. It is significant to highlight that we are aware that there have been times when a medical license may be removed simply due to practicing methods that are not approved by the pharmaceutical industry. In these cases, it shows that revoking the license has very little to do with their competency and more to do with their failure to create an alliance with the pharmaceutical industry.
Response to claim that Delta Institute has a “secret scam clinic” in the United States:
Delta Institute International Health Restoration & Research Club offers two programs to their private club members. These programs include the Delta Home Program and a hybrid option which incorporates both the Delta Home Program and a stay at the Delta Member Retreat. We believe our innovative approach to health restoration is the key to establishing complete health. Each program is innovative and provides excellent combinations for a positive remedial outcome for the member. This model allows us to serve members from all over the world.
It is not a secret that we did have a research center in the United States at one time. That center was relocated in 2013 to better serve our members from all over the world. The medical director of that research center was licensed in the United States.While some would like the public to believe this research center is still being operated in the Unites States, this is simply not the case. Response to claim that Dr. Smith has a fake doctorate originating from a degree mill:
Dr. Smith is a highly-educated individual with a passion for understanding the root cause of chronic conditions. He received his B.A. degree in science from the University of North Dakota School of Medicine. Dr. Smith received his Ph.D. from Canterbury University after completing a rigorous course requiring 92 credits and a 4-year degree.Jen from Canterbury University says of Dr. Smith, “We consider Dr. Smith among our most respected alumnus.” Canterbury University is a legitimate private school. From their website:
“Canterbury University is an internationally administered tertiary level academic institution with incorporated and unincorporated structures in multiple jurisdictions and its overall structure ensures that it is legally entitled to conduct itself as a private degree granting institution.”
Because the university lacks accreditation, they have often been labeled a “degree mill”. It is important to understand that accreditation is voluntary and does not guarantee the quality of an institution or the degree they grant. It is equally important to understand that lack of accreditation does not mean that the education provided is not sufficient. In fact, it would not be possible for Canterbury University to obtain accreditation in the United States and many other countries because it is a foreign school.
It is true that the legality of degrees received from Canterbury University were called into question by a court in the United States. The outcome was a victory for all foreign schools serving students from all over the world. It was also a victory for the students who obtained their degrees from a school that was not based in the United States. In just 27 short minutes, it was ruled that degrees from Canterbury University are legal in the United States (Buckhalter, 2009). This ruling helped highlight that it is more important to evaluate the degree program itself, not the accreditation of the University.In fact, there is evidence that Canterbury graduates possess preferred skills over traditional University Graduates. In a study comparing solutions from traditional University Graduates to Canterbury University graduates, 98% of the employers preferred the solution presented by the Canterbury University graduate (Forex News, n.d.). This shows that attending a U.S. accredited university does not necessarily mean that the student will possess the education and skills to be successful in their field of study.
Response to claim that Delta Institute is involved in money laundering:
Delta Institute is not involved in money laundering. Money laundering is the concealment of illegally obtained money, typically by means of transfers involving foreign banks or legitimate businesses. Because members make payments via wire transfer, allegations of money laundering have surfaced. Delta Institute is an international company, serving members and affiliates from all over the world. Any member or company associated with the BX Protocol™ (like those companies listed by the Leiden team on their disinformation site) have fully audited financials and are legally compliant within their respective jurisdiction.
Response to claim that Dr. Smith is a felon and that his mugshots are available on the internet:
These claims are misleading and have no merit. Dr. Smith was ticketed in 2002 for protesting a beef and poultry contamination incident. The protest was aimed at a food chain and the USDA. When refusing to leave the property, he was written a ticket and released. This type of misdemeanor required a mugshot under a plea in abeyance. Dr. Smith has NO arrest and NO conviction. While Dr. Smith respects the laws in his state and country, he offers no apologies and is proud of his actions in this instance. He will always exercise his constitutional right to protest peacefully against unjust activities that harm others.
In 2013, Dr. Smith was ticketed for target practicing on a gun range that had been the active gun range in the area for nearly 20 years. Dr. Smith was unaware that the property was under new ownership.The new owner of the property requested that police start ticketing people if they came on the land. That is the owner’s right and Dr. Smith was more than happy to pay the fine. This was a misdemeanor trespassing charge and again under a plea in abeyance, mugshots were required. Again, there was NO arrest and NO conviction.
Dr. Smith takes full accountability for his choices. The website used to locate the “mugshot” of Dr. Smith allows the person to request that their record be removed. Dr. Smith has made no effort to hide the tickets and has not requested the photo be unpublished. He has no problem offering an explanation to anyone who shows concern for his perceived criminal background. It is clear that he is not a felon, nor is he “wanted” by any governmental agency. Pictures, such asExhibit A (above), have been created to mislead those who are interested in the BX Protocol™. It is our desire to provide factual information to dispel these fabrications. Please do not be fooled by childish pictures and fictional stories.
Response to claim that cancer patients have died while on the BX Protocol™ due to choosing our program over chemotherapy:
Statements such as the one above are taken out of context and are made to cause fear and confusion. No allopathic or alternative protocol has a 100% success rate. Delta Institute does not claim that a member will be cured. The disclosures on the website and in the membership agreement, along with the affidavit show evidence of this. Prospective members must have a consultation with one of our doctors to determine eligibility. Even though a prospective member meets eligibility requirements, it does not mean we can guarantee a successful outcome. If a potential member is approved, they are encouraged to conduct independent research on their options in an attempt to determine which treatment plan is best for them. This is a very personal decision for each member and we respect whatever path they take.
It is also important to understand that chemotherapy is not a cure for cancer. Choosing chemotherapy does not guarantee survival (Harrington & Smith, 2008). Chemotherapy is not a cure for cancer and is not always the best option for an individual diagnosed with cancer. A McGill Cancer Center survey which was cited in the book “Reclaiming Our Health”, written by John Robbins (1996), calls out:
“75% of Americans diagnosed with cancer are said to receive chemotherapy treatment, which is of course suggested (and prescribed) by their oncologist. But, 75% of oncologists also said that if they had cancer, they themselves would NOT use chemotherapy treatment.”
Leading the public to believe that chemotherapy will cure cancer is a disservice. When 75% of the prescribing physicians would not partake of the same treatment they are recommending, the patient should conduct further research on their options. There are alternative medical treatments that offer similar success rates, if not better. Each individual has the right to select the treatment plan that feels right for them, even if it isn’t in agreement with the pharmaceutical companies or their physicians.
There are a handful of obituaries presented as documented cases where members passed away. Considering that 30% of Delta’s enrollments for cancer support are in hospice care, these death cases cited are extremely low. They are presented as people who chose the BX Protocol™ over chemotherapy or other treatment. The picture painted of their cases does not depict the full story. Many of these members with end-stage cancers reported that they experienced improved quality of life while on the protocol. Conventional oncology experiences a 100% failure rate given a similar population, with no quality of life improvement.Deborah Childs (2011) in her book “A Dose of Reality: Losing William to the Big Business of Cancer in America” said,
“I would eventually realize from William’s [stage 4 colon cancer patient] situation that standardized care providers who are given the power to protect the health of Americans are doing exactly what they are accusing the alternative therapists of doing – failing to save patients, while making huge profits from treatments that far too often do not work.”
The reality is, even oncologists in the conventional medical profession cannot guarantee that the treatment plan they are recommending will cure their patient. It is hypocritical to condemn an alternative medical treatment when conventional oncology also experiences loss of life regularly. We understand that there are immoral people in this world who promise a cure at a costly price and fail to deliver, but they exist in both the conventional and alternative medical fields. If ANY medical provider promises a cure, it is important to conduct independent research to evaluate the claim being made.
It is also critical to understand that much of the information presented regarding the members who passed away is incomplete or completely inaccurate. It is presented to mislead, cause confusion, and instill fear. It is important to understand the following:
Multiple individuals presented as cases to represent that a “member died from the BX Energy Catalyst™” chose to use chemotherapy in conjunction with the protocol. The claim that they chose the BX Protocol™ over chemotherapy and it killed them is completely false.
It is presented that Delta preyed on these individuals by taking their money and selling them false hope while they were suffering from end-stage cancers. Clear expectations are always set with potential members and no guarantees are given. Additionally, many of the individuals presented did not contribute their personal funds to the program. Several of the cases cited were free trials or case studies. In the unfortunate event a member pays for membership and passes away, the membership is fully transferrable.
More than one individual presented experienced improved quality of life AND extended their life. One member presented was on hospice and was told by his physician that he could die any day. When he began the program, his only expectation was to extend his life by 30 days at most. This particular member extended his life by over two years and was more than pleased with his results.
Health professionals recognize that there are significant challenges regarding health restoration in end-of-life cases. However, the video shows his quality of life was drastically improved during the last month of his life and his family was grateful to have extra time to spend with him. Response to claim that before you begin treatment, you must sign an extensive release form with multiple warnings including the phrase, “not intended for the use in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment, or prevention of disease.”
Regulatory statements like these are often required in order to meet the legal requirements of specific countries. This specific statement helps us comply with various governmental regulations. The intent of the release form is to provide the member with adequate information to determine if the benefits outweigh the risks. This empowers the member to decide for themselves whether or not they would like to participate in the program. We encourage potential members to ask questions and read the agreement in its entirety. The Delta Institute understands the importance of making the right decision when it comes to your health and encourages potential members, together with their physicians, to make an informed decision.
Some may find it interesting that Delta Institute International would place any emphasis on FDA compliance as a non-U.S. international business organization with its offices, servers, doctors, and manufacturing facilities outside of the geographical boundaries of the United States of America.However, it’s critical that citizens of the United States, and other western democracies, understand that the FDA is an International Food and Drug Agency, not just a U.S. jurisdictional authority. The FDA has operational posts in many of the 22 countries associated with Delta Institute International Limited. It is, therefore, critical that members understand the complexities related to the FDA’s Global Task Force, and the necessity to synchronize Delta’s global model with the FDA’s worldwide standardization of health regulation.
The first priority for Delta is for the potential member to understand what Delta’s products and services are, and what they are not. This is a very complex issue as it pertains to definitions regarding drugs, medical advice, dietary supplements, food, medical devices, and the overall intended use of a product or technology with respect to particular jurisdictions. Each of these must be understood in order for the potential member to gain insight with respect to Delta’s efforts to maintain compliance within each particular jurisdiction.
Drug Definition
SEC. 201. [21 U.S.C. 321] (g)(1): The term “drug” means (A) articles recognized in the official United States Pharmacopoeia, official Homoeopathic Pharmacopoeia of the United States, or official National Formulary, or any supplement to any of them; and (B) articles intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in man or other animals; and (C) articles (other than food) intended to affect the structure or any function of the body of man or other animals; and (D) articles intended for use as a component of any article specified in clause (A), (B), or (C). A food or dietary supplement for which a claim, subject to sections 403(r)(1)(B) and 403(r)(3) or sections 403(r)(1)(B) and 403(r)(5)(D), is made in accordance with the requirements of section 403(r) is not a drug solely because the label or the labeling contains such a claim. A food, dietary ingredient or dietary supplement for which a truthful and not misleading statement is made in accordance with section 403(r)(6) is not a drug under clause (C) solely because the label or the labeling contains such a statement.
This definition underscores the difficulty in avoiding drug regulation. The first part of the definition simplifies compliance to a large extent, which reads: “intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease”. That is easily achievable by way of the various disclaimers, affidavits, disclosures, and education that Delta Institute attempts to provide its members. However, the second statement contains some very broad language as part of the definition of a drug:
“(C) articles (other than food) intended to affect the structure or any function of the body of man or other animals;”
The FDA clearly states that the regulation of supplements, for instance, fall under a different set of regulations than those covering conventional foods. With this in mind, we are expected to define “unapproved drugs” as any supplement which is intended to affect any structure or function within the human body. It seems ludicrous, and certainly the FDA does not have a current campaign against these products. However, the two examples above illustrate the broad powers claimed by the FDA and the need for clear and accurate disclosures to the consumer regarding the intended use of Delta Institute’s dietary supplement products.
Response to claim that Delta Institute uses cheap products made in China and then resells them at 10 times the price:
Energenetix does purchase enclosure units from China in the interest of saving money for its clients. However, all of the circuitry and research that goes into the “empty box” has originated from research conducted by seasoned engineers and researchers employed by Energenetix or related companies. The quality of these products is not compromised by using enclosure units that will reduce overall costs for clients.The technologies are only available to certified affiliates or Delta members.
The average cost of Energenetix equipment ranges between $4,000-$12,000. X-Ray radiation therapy machines average around $3 million each. These machines are far more expensive and have been shown to do more harm than good. A study conducted at the UCLA Jonsson Comprehensive Cancer Center (Printz, 2012) describes how radiation treatments actually promote malignancy in cancer cells instead of eradication. We encourage individuals to conduct independent research on radiation therapy to determine which treatment option is best for them. Delta Technologies include more than Ka bands. Ka band is simply a frequency range that covers the frequencies of 26.5–40 GHz. Depending on the amplitude and the use of the pulse cycle. If you are interested in the effect of the Ka band on Bacterial Mutagenesis, we recommend conducting independent research. Members are not paid for their testimonials and they are not actors. The testimonials provided document actual member experiences. Many testimonials document the experience of users over the course of 12 months or more. They explain the challenges and successes of the health restoration process. This allows viewers to draw their own conclusion of whether or not the BX Protocol™ is effective and if they would like to explore whether or not the BX Protocol™ is an appropriate treatment option in their case. Testimonials should not be the only reason a person purchases our membership program. Because no two members are the same, we require that potential members have a consultation with one of our doctors to determine if they meet eligibility requirements. Response to claims that the BX Protocol™ is not valid because it is not published in a peer review journal:
There is a common misconception that if a treatment option has not had studies published in a peer review journal, then it is invalid and should not be considered an appropriate method of treatment. It is important to understand that this is not always true. In recent years, the peer review process has been called into question on multiple occasions. In an article published in the Wall Street Journal (Campbell, 2014), problems with the peer review process were highlighted, including:
Approved peer review papers being retracted due to an author exploiting the process by giving glowing reviews of his own research using phony names.
There has been an increase in approved peer review papers being retracted due to the authors misrepresenting information which has led to the inability to reproduce study results.
A 2011 report in the monthly journal Nature Reviews Drug Discovery showed that the results of two-thirds of 67 key studies analyzed by Bayer researchers from 2008-2010 COULD NOT be reproduced.
Researchers are often poorly trained in experimental design and many publications do not report basic elements of experimental design.
Some scientists withhold or vaguely describe key pieces of their research to retain a competitive edge, resulting in the inability to duplicate results.
Some journals allow panel members to agree in advance to giving a paper a favorable review to help it get published.
Additional flaws in the peer review process have continued to surface. While there are many peer reviewed scientific claims that are easy to replicate, there are a high number of papers being retracted for not meeting publication criteria. It is not uncommon for the peer review system to reject scientifically valid research while accepting bogus research that cannot be replicated. Journals and researchers often gain notoriety and financial gains despite publishing invalid research that did not truly meet the peer review criteria. This statement is not entirely true. It is true that once a member is accepted, their membership dues are non-refundable. The private membership dues are based on member value-added benefits.We encourage potential members to read through the membership agreement in its entirety so they understand exactly what they are agreeing to. In the event it is determined that the applicant is ineligible for membership upon making payment, the entire club membership fee is returned to the applicant. It is also important to note that the membership is fully transferrable in the event a member is unable to complete the program. The member may transfer the membership to a friend or family member that meets membership criteria.
