Keine Zivilehe in Israel

A prominent Charedi Sephardi rabbi in Israel ruled that religious people should not look at the 50-shekel banknote because the poet featured on its front was married to a Christian woman.

Rabbi Benzion Mutzafi reportedly made the ruling over the weekend concerning the bill showing Shaul Tchernichovsky, a renowned Hebrew poet who was married to a non-Jewish Russian woman named Melania Karlova. The ruling was first reported on the Charedi news website Kikar Hashabbat.

The bill was unveiled in 2014.

“They say that at the time, (then-chief rabbi) Rabbi Avraham Kook begged, implored and asked him to try to convince her to convert to Judaism. And he refused,” Mutzafi reportedly said of Tchernichovsky.

The rabbi also said: “In our tradition, there are grave things written about whoever (lives) with a Christian. Tied to him like a dog. (They) are called apostates.”

Mutzafi reportedly took out a 50-shekel banknote and told one of his students that he was forbidden from looking at it. The rabbi said he keeps such banknotes folded with the portrait on the inside so he does not have to look at it.

The Jerusalem Post reported that the rabbi also gave the same ruling in the Ask the Rabbi section of his website.

In our tradition, there are grave things written about whoever (lives) with a Christian. Tied to him like a dog. (They) are called apostates.”

Das sagt er: "Rabbi Benzion Mutzafi went so far as to assert that we should punish those who keep them alive!"

Der Herr Rabbiner will jene "bestrafen" (Wie?

Ask the Rabbi: May one kill a subdued terrorist?
By RABBI SHLOMO BRODY
December 3, 2015 14:39

"The goal of our nation is to execute justice, not captured prisoners."

Israel has tragically suffered recently from a “wave of terrorism” by terrorists wielding knives and guns. Soldiers and citizens alike have bravely fought back against these assailants, significantly reducing the casualty toll.

Frequently, the terrorists were killed by these acts of self-defense, which remain morally justified while the terrorists represent a danger. In a few cases, however, bystanders continued to attack the terrorists even after the threat had been clearly neutralized (i.e., the terrorist was lifeless or subdued), raising heated debate within society whether these were justified acts of vengeance. While I have no sympathy for these ruthless terrorists, I believe that Jewish law does not permit such action.

Jewish law prohibits the intentional killing of innocents, both Jewish and non-Jewish alike. This prohibition was included in the seven Noahide laws and reaffirmed even after God elected a “chosen people” and gave them the Torah. There are times, however, when a person may kill someone else, as in cases of mandated warfare or acts of self-defense.

The right to self-defense is exemplified within Jewish law by the law of rodef (the pursuer).

The Sages contend that the verse “You shall not stand idly by the blood of your neighbor” not only demands saving a friend from drowning or from a hungry lion, but further dictates stopping an assailant from committing murder. This mandate was extended to both threatened victims and bystanders alike. It further includes cases in which a generally righteous person is unjustifiably attacking a known miscreant, or if a Jew is assailing a non-Jew.

Jewish scholars debated what guidelines might be issued for those trying to stop the assailant. Some believed that the rescuer may kill at all costs under all circumstances because the attempted murderer has, as it were, abdicated his right to life by making himself subject to the laws of rodef.

Yet the normative law asserted that when possible, one must use a less lethal method, such as cutting off a hand or debilitating the legs. A few scholars proposed an intermediate position that would permit the intended victim alone (as opposed to bystanders) to always use lethal force, but this position did not gain widespread currency.

Some figures, including Rabbi Ya’acov ben Asher, believed that a person is even liable for murder for using excessive force in stopping the pursuant. Maimonides, however, deemed it a serious sin worthy of “heavenly punishment” but not warranting penalty from a judicial court.

Some explained that Maimonides felt it was unfair to punish someone who was rushing to stop a murder, even though he could have limited the harm to the assailant. As such, if he was warned on the spot that he was using excessive force, but killed the assailant anyway, he would indeed be liable for murder.

Others asserted that while the rescuer erred, Maimonides believed that we should not punish someone for killing an assailant who ultimately brought his death upon himself.

Of course, no one expects a citizen or even a security officer who has moments to act to calculate exactly how much force might be necessary to stop an assailant.

This would be utterly unreasonable and would prevent people from acting to save the victim. (For similar reasons, the Sages decreed that a rescuer does not pay for property damage that he causes during his act of heroism.) Moreover, it is not always easy to know when a threat has been fully neutralized, especially when a wounded terrorist continues to struggle. Nonetheless, once the assailant is clearly incapacitated, one is not allowed to kill them, whether out of a sense of vengeance or vigilante justice.

During the recent violence, rabbis Shmuel Eliyahu and Moshe Tzuriel have contended that these terrorists should be treated not as regular assailants but as enemy soldiers who may be killed. Rabbi Benzion Mutzafi went so far as to assert that we should punish those who keep them alive! Yet even if we assume that lone-wolf attackers should be treated as enemy soldiers (and not regular assailants), it’s unclear why they retain that status once they’ve been captured or debilitated. Should we kill enemy soldiers who wave a white flag on the battlefield? Why not wipe out the jail cells of all convicted terrorists? Eliyahu argued that these assailants might ultimately go free and return to terrorism.

Yet the proper response to that problem is to stiffen jail terms and not engage in lopsided prisoner swaps that free murderers.

In any essay published many years ago, Rabbi Yehuda Henkin (whose son and daughter-in-law were tragically killed in this wave of terrorism) further noted that killing a captured enemy combatant goes against international norms and would thus constitute a hillul Hashem, a desecration of God’s name. Moreover, as Rabbi Yaakov Ariel recently noted, the inevitable recording of such executions might further enrage our enemies and add to the threats against us. Ariel has also argued that while military assassinations are sometimes necessary, those decisions must be made by military experts, not vigilantes. Indeed, the danger of citizens taking the law into their own hands has been tragically displayed by brutal attacks on innocent bystanders who were mistaken for terrorists.

Perhaps the most cogent argument has been issued by Rabbi David Stav, who beseeched us not to descend to the moral depravities of our enemies by killing unnecessarily.

The goal of our nation is to execute justice, not captured prisoners.

Killing Palestinians “a Religious Duty” say Rabbis
Published at: 15:00, October 18, 2015 by Stephen J. Lendman

This poisonous ideology persists in Israel. Radicalized rabbis preach it. Nothing is done to stop them.

Zionist zealot rabbi Meir Kahane’s pure evil lives, founder of the Arab-hating Jewish Defense League (JDL). Israel banned it in 1988, calling it a “threat to national security.”

Even the Islamophobic Anti-Defamation League (ADL) said its membership includes only “thugs and hooligans” – dedicated to hate-mongering and violence against Palestinians.

Its poisonous ideology persists in Israel. Radicalized rabbis preach it. Nothing is done to stop them. Hate-mongering rabbis responded to questions including: “Am I allowed to kick the insurgent, hit him or shoot him in order to kill him after he has been arrested or is this prohibited?”

Rabbi Rav Benzion Mutzafi said “(i)t is not only desirable to do so, but it is a religious duty that you hold his head down to the ground and hit him until his last breath.”

City of Safed chief rabbi Shmeul Eliyahu said it’s “prohibited to keep (Palestinian ‘vandals’) alive after (their arrest), because if (they’re) left alive, there is a fear that (they’d) be released and (be able to) kill others.”

Since October 1, Israel arrested around 700 Palestinians, many held uncharged, others accused of stone-throwing and/or threatening public security.

The Palestinian Prisoners Club said half of those detained are children, denied contact with family and legal counsel, subjected to brutal torture, forced to confess to whatever charges Israel concocts.

Other children are being lethally shot. Defense for Children International-Palestine’s Accountability Program director Ayed Abu Eqtaish said:

“It’s now a matter of when the next Palestinian child fatality will occur and not if it will take place. The complete disregard for human life that Israeli soldiers exhibit suggests that the use of lethal force is their standard operating procedure whatever the circumstance.”

Hamas and Islamic Jihad called for Palestinian solidarity against Israeli repression and occupation. They saluted brave martyrs, sacrificing their lives for freedom.

The Popular Front for the Liberation of Palestine (PFLP) called on Palestinians to condemn US support for Israeli viciousness. Be wary of John Kerry’s upcoming visit, it stressed – aimed only at ending resistance against repressive occupation, issuing a statement, saying:

“The United States presents a strong barrier in front of our people and our rights in all international forums, and uses the veto as a weapon wielded dozens of times to prevent our people from exercising their right to self-determination.”

“The United States was and still is the head of the snake which spreads poison and sectarian wars to the Arab nation.”

On Friday, John Kerry’s spokesman issued a statement saying, he “strong(ly) condemn(ed) (Palestinian) terror attacks against innocent civilians, and (expressed) support for Israel’s right to defend its citizens.”

An Islamophobic Wall Street Journal editorial accused Palestinians of being knife-wielding terrorists – calling their heroic self-defense “terrorism in its most exact and repulsive form.”

Journal editors endorsed Israeli state terror, saying if its “critics…think they could do better under similar circumstances, they ought to explain how” – ignoring Netanyahu-ordered provocations, then unleashing violence, Israel’s usual tactic, brutalizing defenseless civilians.

The following statement was issued by human rights groups listed below:

“Since the beginning of the current wave of violence, there has been a worrying trend to use firearms to kill Palestinians who have attacked Israelis or are suspected of such attacks.”

“Several incidents have been documented and reported, raising concern that the chosen response to such persons is the harshest possible, with lethal or – at the very least – unnecessary consequences.”

“In instances when Jews have been suspected of attacks, none of the suspects has been shot. Politicians and senior police officers have not only failed to act to calm the public climate of incitement, but on the contrary have openly called for the extrajudicial killing of suspects.”

“They have also urged civilians to carry weapons. For example, Jerusalem District Police Commander Moshe Edri was quoted as saying: ‘Anyone who stabs Jews or hurts innocent people is due to be killed.’ “

“Interior Security Minister Gilad Arden declared that ‘every terrorist should know that he will not survive the attack he is about to commit.’ MK Yair Lapid stated that ‘you have to shoot to kill anyone who pulls out a knife or screwdriver.’ “

“Much of the media joined in and encouraged a similar approach. The bodies responsible for supervising police operations – the State Attorney’s Office and the Department for the Investigation of Police – remained silent in the face of these comments.”

“No-one disputes the serious nature of the events of recent days, nor the need to protect the public against stabbing and other attacks.”

“However, it seems that too often, instead of acting in a manner consistent with the nature of each incident, police officers and soldiers are quick to shoot to kill. The political and public support for such actions endorses the killing Palestinians in the Territories and in Israel.”

“Rather than imposing collective punishment on Palestinians in the West Bank (including East Jerusalem) and the Gaza Strip, the Israeli government should act to end the reality of ongoing and daily oppression faced by some four million people who live without hope of any change in the situation, without any horizon for the end of occupation, and without prospects for a life of liberty and dignity.”

A Final Comment

Maan News said an Israeli settler lethally shot a Palestinian teenager around midday on Saturday – near the Beit Haddassah outpost.

Area resident Mufeed Sharabati said “paramedics of the Palestinian Red Crescent (Society) arrived, but Israeli soldiers didn’t allow them to access the (victim).”

“The soldiers then covered (his) face and took him in an ambulance to (an) unknown destination.” Settlers celebrated his death by “distributing candies.”

Witnesses saw Israeli soldiers place a knife by his lifeless body – to be able to claim he attempted to stab his assailant.

The incident came shortly before soldiers lethally shot another Palestinian teenager in Jerusalem. As of midday Saturday local time, the Palestinian death toll stands at 40 since October 1.
