Tal y como es público y notorio, Mons. Xavier Novell i Gomà, obispo emérito de Solsona, ha contraído matrimonio civil con Dª. Silvia Caballol y Clemente, con fecha 22 de noviembre de 2021 en la población de Súria, de la provincia de Barcelona.
Ante este hecho grave, cabe poner de manifiesto que el canon 1394.1 del Código de Derecho Canónico de la Iglesia Católica estipula que «el clérigo que atente matrimonio, aunque sea sólo civilmente, incurre en suspensión latae sententiae».
Por tanto, desde el mismo momento en que Mons. Xavier Novell i Gomà contrajo matrimonio civil, se produjo, de forma automática, la consecuencia prevista en el canon anteriormente citado. Esto es, que le quedan prohibidos todos los actos de la potestad de orden, los actos de la potestad de gobierno y el ejercicio de todos los derechos y funciones inherentes al oficio episcopal (cf. c. 1333.1), sin excluir otras posibles consecuencias que pudieran seguirse canónicamente.
Esto significa que Mons. Xavier Novell i Gomà, aunque manteniendo su condición de obispo, no puede desarrollar ninguna de las funciones que se derivan de tal condición; entre otros, tiene prohibida la administración de los sacramentos y cualquier actividad magisterial, tanto en público como privado.

Apostolic Administrator of Solsona
Xavier Novell i Gomà, Bishop Emeritus of Solsona, has contracted a civil marriage with Ms. Silvia Caballol y Clemente, on November 22, 2021 in the town of Súria, in the province of Barcelona.
In view of this serious fact, it should be pointed out that canon 1394.1 of the Code of Canon Law of the Catholic Church stipulates that "the cleric who violates marriage, even if only civilly, incurs in suspension latae sententiae".
Therefore, from the very moment that Bishop Xavier Novell i Gomà contracted a civil marriage, the consequence foreseen in the aforementioned canon was automatically produced. That is, he is prohibited from all acts of the power of order, acts of the power of government and the exercise of all the rights and functions inherent to the episcopal office (cf. can. 1333.1), without excluding other possible consequences that could follow canonically.
This means that Bishop Xavier Novell i Gomà, while maintaining his status as bishop, cannot carry out any of the functions that derive from such status; among others, he is prohibited from administering the sacraments and any magisterial activity, both in public and private.
